菲律賓-起運港裝船前檢驗（LPSR）詳解
一：目的：
1. To further implement AO 234A – 2009 and to streamline existing rules on the requirement for load port survey on imported cargoes;
為了進一步落實行政法令號 234-2009和優(yōu)化目前針對進口貨物起運港裝船前檢驗的要求;
2. To promote trade facilitation for cargoes with LPS report by providing an advance clearance system;
通過預(yù)清關(guān)系統(tǒng)，促進經(jīng)起運港裝船前檢驗（LPS）貨物進口的便利化；
3. To secure advance and reliable information for examination and assessment of cargoes;
為了確保可以預(yù)先獲得可靠的貨物信息，對產(chǎn)品進行檢查和評估；
4. To promote revenue protection and to ensure the correct weight, quantity, quality, origin and description of cargoes.
為了促進并保障財政關(guān)稅收入，并確保正確的重量，數(shù)量，質(zhì)量，原產(chǎn)地以及貨物的描述
二 COVERAGE 覆蓋產(chǎn)品范圍
1. Unless exempted under this Order, all bulk, break-bulk, containerized and non-containerized cargoes arriving and entering in any port of entry of the Philippines shall be subject to a Load Port Survey (LPS) at the Port of Origin.
除非本發(fā)令豁免的產(chǎn)品，其他所有散貨，散雜貨，集裝箱及非集裝箱裝載的貨物都必須在，進入菲律賓任何港口前，在起運港進行裝船前檢驗（LPS）。
2.Bulk and break-bulk cargoes may include but are not limited to the following:
散貨和散雜貨包括以下產(chǎn)品但不限于以下內(nèi)容：
1) Liquids液體
2) Chemicals化工品
3) Petroleum Products石油制品
4) All other cargo shipped in bulk and break-bulk (e.g. wood, iron, steel, coal, grains, etc.) 所有通過散貨和散雜貨方式運輸?shù)呢浳铮ㄈ缒静?，鐵，鋼，煤，谷物等）
3. Imported cargoes surveyed by STEK at the Port of Origin shall be covered by a Load Port Survey Report (LPSR) and Summary Report. The procedures and information needed shall be detailed in the implementing rules and regulations.
經(jīng)STEK在起運港進行裝船前檢驗的進口貨物，將出具裝貨港檢驗報告（LPSR）和總結(jié)報告。具體的程序和所需的信息將根據(jù)細則和條例實施。
4.Cargoes entered into free ports and bound for the customs territory shall be subject to the requirement of LPSR as provided in this Order.
進入自由港或海關(guān)關(guān)境的貨物應(yīng)符合本法令所規(guī)定的起運港裝船前檢驗報告（LPSR）要求。
5.Vehicles for special purpose (e.g. cranes, backhoes, bulldozers, ambulances, trucks, buses and the like) entered into the free ports for conversion or retooling, and not previously covered by an LPSR, shall be subject to the conduct of Discharge Port Survey (DPS) prior to withdrawal from the free port into the customs territory. The provision on the imposition of the administrative penalties under Section 8 of this Order shall not apply in this particular case.
特殊用途車輛（如起重機，挖土機，推土機，救護車，卡車，公共汽車等）進入自由貿(mào)易港區(qū)的轉(zhuǎn)換或再加工的，以及之前沒有在起運港裝船前檢驗（LPSR）檢驗范圍內(nèi)覆蓋的產(chǎn)品，應(yīng)在從自由貿(mào)易港區(qū)進入海關(guān)關(guān)境前進行卸貨港檢驗Discharge Port Survey (DPS)。關(guān)于征收根據(jù)本發(fā)令第8條執(zhí)行的行政處罰，不適用于在這種特殊情況下。
三 DESTINATION INSPECTION FOR CARGOES WITHOUT LPSR.
沒有經(jīng)過LPSR檢驗的貨物進行目的港檢驗
1. All bulk, break-bulk, containerized and non-containerized cargoes not otherwise exempted under Section 4 of this Order and which arrived without the required LPSR shall be subject to a Discharge Port Survey (DPS) to be conducted by the COTECNA.
所有散裝，散雜貨，集裝箱以及非集裝箱貨物及根據(jù)本法令第4條規(guī)定的不能獲得豁免的貨物，如果沒有進行LPSR檢驗，必須在目的港由COTECNA 在卸貨港安排檢驗。
2. Any expense or charges arising from the conduct of the DPS on the cargo shall be for the account of the importer. 所有目的港卸貨港檢驗產(chǎn)生的費用將由進口商承擔。
3. All Importers who failed to secure a LPSR as required in this Order shall notify the Office of the District Collector of the concerned port prior payment of the applicable fine and the conduct of a DPS for bulk cargoes,. Upon proper notice, the District Collector shall ensure the payment of the fine and the conduct of the DPS before the cargo is released from customs custody.所有未經(jīng)裝船前（LPSR）檢驗進口的貨物，將被處以相應(yīng)的罰金和目的港（DPS）檢驗的費用。并在確保罰款繳付和目的港檢驗（DPS）完成后，貨物才能從海關(guān)放行。
4. The District Collector concerned shall submit a weekly report to the Port Operations Service (POS), Assessment and Operations Group (AOCG) of all violations of this Order.
相應(yīng)關(guān)區(qū)應(yīng)向港區(qū)操作服務(wù)部（POS）和評估小組（AOCG）提交的每周報告匯報所有違反本法令的貨物情況。
四 ADVANCE IMPORT CLEARANCE 進口預(yù)清關(guān)
1. All cargoes covered by an LPSR shall be automatically exempted from physical and x-ray inspection, except in instances:
通過裝船前檢驗LPSR的貨物，自動免除海關(guān)和X-Ray掃描儀檢驗，除非
a. The LPSR has been tampered or shows signs that the same has been tampered;
LPSR檢驗報告被篡改，或者簽名被篡改的。
b. The shipments is covered by an alert or hold order;
存在警示或受控的貨物。
c. The importer disagrees with the findings of the LPSR and requests that a DPS be conducted in the presence of customs officers; and
進口商對LPSR檢驗報告存在不同意見，并要求海關(guān)在場進行目的港DPS檢驗。
d．If the Commissioner of District Collector has derogatory information against the shipment.海關(guān)官員有跡象對貨物存在疑問。
2. In addition, BOC shall provide for the procedures to allow the filing and clearance of import entry declarations even prior to arrival of the goods under conditions to be provided in the implementing rules and regulations.
此外，海關(guān)應(yīng)提供的詳細流程，在實施細則和條例規(guī)定的條件下，對進口貨物備案和報關(guān)清關(guān)。
五 CARGO SURVEY FEES. 貨物檢驗費
COTECNA shall be allowed to charge fees payable by the exporter, unless otherwise agreed upon by and between the importer and exporter, and as provided in the rules issued by the Committee on Accreditation of Cargo Surveying Companies (CACSC).
檢驗費用由出口商支付給檢驗公司，除非進口商和出口商之間另有約定，并根據(jù)檢驗公司認可委員會（CACSC）頒布的規(guī)則規(guī)定。

六 VIOLATION AND PENALTIES. 違規(guī)和處罰
1. It is the duty of importers and consignees to make sure that their cargoes undergo the required LPS, with the corresponding LPSR issued. All importers who failed to secure a LPSR for their imported cargoes shall be accept the corresponding administrative punishment
作為進口商和收貨人的責任，必須確保貨物在起運港進行裝船前檢驗，并取得相應(yīng)的LPSR證書。所有的進口商沒有獲得LPSR證書，進口的貨物須接受相應(yīng)的行政處罰。
2.The imposition of any fine or penalty under this Order shall be without prejudice to the imposition of applicable administrative and criminal penalty arising from any finding of violation of other customs laws, rules and regulations as a result of the conduct of the DPS or the physical inspection. 根據(jù)本法令的實施任何罰金或處罰，不影響任何違反其他海關(guān)法律，法規(guī)和規(guī)章所實施行政和刑事處罰。
